A Cautionary Tale: EPA Lists PFOA and PFOS as Hazardous Substances

The Biden administration has aggressively moved to regulate per- and polyfluoroalkyl substances (PFAS) in various ways. Regarding PFAS as a critical environmental and public health issue, the administration has implemented regulations outlined in the PFAS Strategic Roadmap, including the establishment of national primary drinking water standards for PFAS.

Most recently, the Environmental Protection Agency (EPA) designated two PFAS—PFOA and PFOS—as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). The EPA simultaneously announced a PFAS Enforcement Discretion and Settlement Policy, which alleviates some of the harsh consequences of this new rule.
