That should be an easy question for most practitioners. The court rules prescribe set time periods for due dates for discovery. But, what about due dates for discovery that is served with the complaint? That answer is not as simple.
The court rules set forth the following written discovery deadlines:
- Rule 4:17-4(b): Interrogatory answers are due 60 days after service.
- Rule 4:17-1(a)(2): Uniform personal injury/property damage interrogatory answers are due from plaintiff 30 days after the answer is served by defendant and due from a defendant 60 days after the answer is served.
- Rule 4:17-1(a)(1): Supplemental interrogatory questions for personal injury actions subject to answering uniform interrogatories (any party may serve 10 supplemental questions), they would be due in 60 days after service based upon Rule 4:17-4(b).
- Rule 4:18-1(b)(2): Document request responses are due 35 days after service.
- Rule 4:22-1: Request for admission responses are due 30 days after service.
