The Utah Supreme Court reversed a district court’s rejection of a suit brought by a woman who sought court records pertaining to her adoption, concluding the lower court failed to properly balance the weight of the woman’s reasons for wanting to see the records and her birth mother’s privacy interests.
In the Feb. 22 opinion, Justice John A. Pearce reversed a district court’s denial of a woman’s petition to unseal her adoption file to discover information about her birth parents, concluding the lower court erred in relying on the Legislature’s decision to seal the adoption records for 100 years to derive the meaning of “good cause.”
