An appellate court in Rochester heard arguments on Monday as to whether a Democratic-led constitutional amendment proposing to codify abortive rights and access to abortion care in the New York State Constitution should be included on November’s statewide ballot.
The Appellate Division, Fourth Department explored the possibility that a May ruling by a trial court judge from Livingston County, excluding the Equal Rights Amendment from the November ballot on procedural grounds, was in error.
