- Dallas County’s sheriff wants the Texas Supreme Court to find unconstitutional a law creating a statewide appellate court.
- The sheriff claims the legislature deviated from the state constitution, which does not provide statewide jurisdiction for a district court of appeals.
- In the underlying case, the sheriff is suing a state agency for not timely transferring insane inmates out of the county jail.
The Dallas County sheriff is challenging the constitutionality of a newly created statewide appellate court—to head off further delay of a lawsuit against Texas Health and Human Services Commission.
The state commission, in an appeal to the Austin Court of Appeals gave notice that it expects the case to transfer Sept. 1 to the newly created Fifteenth District Court of Appeals.
