Resolving Litigation: Equal Empathy for Tenants, Landlords Highlight ‘Radical Neutral Advocacy’

As a general counsel for two tech companies, I saw how litigation grinds parties down through processes that too often distract from the facts and law in dispute. Those experiences led me to co-found a company providing truly alternative dispute resolution services that remove the gamesmanship and pain that has long-plagued dispute resolution in legacy arbitration or courts. Through this we’ve grown to admire neutrals, lawyers and other folks who’ve dedicated themselves to innovating how they ply their craft. In this series of monthly articles, we will meet leaders in the world of dispute resolution to share what they have learned about litigation, lawyers, parties, and the art of resolving disputes.

I’m proud to start with Roger Moss of Rincon Resolutions. His company helps resolve residential and commercial real estate disputes. For eight years, Moss founded and directed San Francisco’s Conflict Intervention Service (CIS), which focuses on landlord-tenant issues. During that period, the organization stabilized homes and small business locations for over 6,000 clients. Roger represents alternatives to traditional ways people pursue legal careers, litigation and dispute resolution. His self-described “radical neutral advocacy” commits to bringing compassion and empathizing with each side of a case—an approach sought after by parties in a wide-range of disputes.
