The top court said it dismissed the appeal by Senate Republican Minority Leader Robert Ortt, R-Lockport, on the basis that he and other appellants were not aggrieved parties.

New York’s highest court decided on Thursday that the Equal Rights Amendment, a Democratic-led constitutional amendment proposing to codify abortive rights and access to abortion care in the New York State Constitution, should remain on November’s statewide ballot.

The Court of Appeals’ decision affirms a Rochester appellate court ruling handed down on June 18.
