New York State officials said they are prepared to resume litigation against Purdue Pharma and the Sackler family should the parties fail to agree by a Sept. 9 court-imposed deadline on a comprehensive settlement for damages related to fueling the opioid epidemic.

David Nachman, special counsel for the state Attorney General’s Office, delivered the warning in a letter to state Supreme Court Justice Jerry Gargiulo on Wednesday, a day after U.S. Bankruptcy Judge Sean H. Lane for the Southern District of New York granted Purdue Pharma’s request for a final, 60-day mediation period.
