The Connecticut Supreme Court determined that the litigation privilege, used to protect parties from retaliatory actions for statements that occur during a judicial proceeding, does not apply to alleged abuse of the legal system.
Deutsche Bank AG, the plaintiff, has been attempting to collect a $243 million English judgment from Sebastian Holdings Inc., a nonparty, for the past decade. Sebastian Holdings has claimed it has insufficient assets to fulfill the judgment, the complaint said.
