According to fiscal year 2023 statistics from the Administrative Office of U.S. Courts, and the U.S. Judicial Panel on Multidistrict Litigation, multidistrict litigation now makes up 65% of the federal civil caseload, a far bigger share than the 38% a decade ago.

- The statistics came up this month, when the Committee on Rules of Practice and Procedure voted to approve the new multidistrict litigation rule.
- Lawyers for Civil Justice estimates a much higher figure, claiming that multidistrict litigation made up 71.3% of the docket.
- U.S. District Judge Karen Caldwell, chairwoman of the MDL panel, said at a conference this year that the numbers are skewed by 3M’s earplug docket.
Multidistrict litigation makes up an increasing percentage of the federal civil caseload, prompting much debate over its impact on the federal judiciary.
