McElroy, Deutsch, Mulvaney & Carpenter has asked a U.S. Bankruptcy Court judge to dismiss a Chapter 11 bankruptcy petition by the firm’s former chief financial officer, who pleaded guilty to embezzling more than $1.5 million from the firm.
The firm says former CFO John Dunlea’s Chapter 11 petition should be dismissed because it was brought in bad faith. Dismissal for cause is warranted because Dunlea’s reorganization primarily involves a two-party dispute that can be resolved in state court, McElroy Deutsch said in its motion to dismiss.
