A New York attorney who won a $100,000 judgment for workplace sexual harassment is alleging in a new lawsuit that the state Assembly’s refusal to foot the bill runs afoul of Public Officers Law indemnifying employees for liability within the scope of their employment.
The legislative chamber’s in-house attorney, Rebecca Mudie, stated in a letter to opposing counsel that it is “inconceivable” sexual harassment falls within the scope of an Assembly member’s duties, according to an exhibit of the plaintiff’s lawsuit in state Supreme Court of Erie County.
