A National Labor Relations Board decision on behalf of a Home Depot employee disciplined for wearing “BLM” letters on his apron has kicked open the door to future enforcement against employers that prohibit expressions of politics or social activism on the job.
Employers wary of politically divisive and distracting speech in the workplace would do well to review their employee policies in light of the NLRB’s Feb. 21 interpretation of Section 7 of the National Labor Relations Act.
