The U.S. District Court for the District of New Jersey dismissed a putative class action lawsuit without prejudice against an alleged defect in Mercedes-Benz’s B-Class electric vehicles this week after concluding that the plaintiffs failed to prove plausibility of their state law claims.
The case, filed in March 2023, alleged several defects in Mercedes B-Class EVs made from 2014-17. Claims were filed under state laws for unjust enrichment, negligent misrepresentation, statutory and common-law consumer fraud, breach of express warranty, and breach of the implied warranty of merchantability.
