For the first time the Connecticut Supreme Court ruled in a 4-3 decision that total incapacity under workers’ compensation law does not entitle someone to permanency benefits as a matter of law.
In line with case law in the 2019 Connecticut high court decision Brennan v. City of Waterbury, the majority held that the “absence of a permanency finding or agreement sufficient for a binding meeting of the minds” bars permanency benefits under Connecticut General Statutes §31-308.
