Fox News has made changes to its counterclaims against Smartmatic in New York Supreme Court, claiming information obtained during discovery shows the damages the voting tech company claims amount to multiples of its historical earnings.
A Fox News spokesperson said the filing responding to Smartmatic’s first amended complaint shows Smartmatic has not been able to substantiate the $2.7 billion in losses it alleges are connected to defamatory statements made on-air by Fox News hosts during coverage of the 2020 presidential election through witness testimony or other discovery.
