Attorneys with Foley Hoag have filed a lawsuit in Massachusetts state court on behalf of the home goods retailer Wayfair after a construction management company allegedly failed to pay subcontractors to complete the work, leading Wayfair to dish out “double payments” of $2.1 million to finish its first retail store in time.
Wayfair, one of the largest online home retailers headquartered in Boston, claims that Loc Associates, doing business as Generis Collective, failed to timely pay money that was earmarked for subcontractors working on the first physical retail store at Edens Plaza in Wilmette, Illinois, as required by a services agreement. Wayfair brings claims of theft of money, fraud, unfair and deceptive trade practices, as well as breach of contract against the construction manager, according to the suit filed July 12 in Suffolk County Superior Court.
