A woman who was raped on a SEPTA train failed to make allegations against the transit agency that could support a state-created danger theory of liability, a federal judge in Philadelphia ruled.
U.S. District Judge Juan Sanchez of the Eastern District of Pennsylvania dismissed plaintiff K.B.’s claims Tuesday, holding that she failed to demonstrate that SEPTA actively contributed to the circumstances that allowed the attack to go on.
