Federal Judge Determines Wife’s Online Tax Account Creation Does Not Bind Husband to Arbitration Agreement

A federal judge in Pennsylvania ruled last week a man isn’t bound to an arbitration agreement with a tax preparation service after his wife clicked the box agreeing to the company’s terms of service when creating an account to complete the couple’s tax return online.

U.S. District Judge Wendy Beetlestone of the Eastern District of Pennsylvania determined genuine disputes of fact existed regarding whether plaintiff Matthew Sessoms was bound to an arbitration agreement with tax preparation company, TaxAct, concluding questions remained regarding whether Sessoms’ wife had authority to bind him to the agreement, after she agreed to the terms of service when she created the account to complete their tax returns.
