The Massachusetts Court of Appeals revived a suit against an ambulance services company, concluding a former employee had standing to sue for her Fair Credit Reporting Act claims over the company’s background check process.
The appeals court concluded that the district court erred when granting EasCare LLC’s motion to dismiss two counts of former employee Nicole Kenn’s complaint for lack of subject matter jurisdiction.
