A diverse workforce brings a wealth of perspectives, experiences, and skills that enhance a law firm’s ability to serve its clients effectively and innovate in an increasingly complex legal landscape. Most law firms want to recruit and retain a diverse workforce. However, recent challenges to diversity, equity, and inclusion (DEI) practices have created uncertainty and obstacles for law firms to achieve those goals. As we see it—a legal recruiter who specializes in working with diverse candidates and the global head of diversity recruiting at an Am Law 100 firm, respectively—firms can and must grapple with these challenges, adapting their strategies and reaffirming their commitment to building a talented, diverse workforce. It’s not just the right thing to do; it’s a business imperative.

The Chilling Impact of the Supreme Court Affirmative Action Decision

In June 2023, the U.S. Supreme Court ruled race-conscious admissions programs at Harvard University and the University of North Carolina were unconstitutional, effectively prohibiting the use of affirmative action in college admissions nationwide. This decision overturned decades of precedent that allowed higher education institutions to consider race as one of many factors in their admissions processes to promote diversity on campus.
