The ruling comes amid broader fighting between the parties over discovery, including a sanctions motion from the firm alleging “Bosworth repeatedly interjected and, on some 46 separate occasions, improperly instructed the witness not to answer questions pertinent to the firm’s claims against him.”

  • A Philadelphia judge was unconvinced by Kline & Specter’s claims that Thomas Bosworth’s dissemination of discovery materials led to threats being made against the firm.
  • The ruling denied, without prejudice, a motion for a protective order governing discovery in the litigation between Kline & Specter and Bosworth.
  • Both parties have filed motions for sanctions and accused their opposition of trying to hold up the discovery process.

Kline & Specter’s claims that it has been the target of threats and antisemitic messages spurred by ex-associate Thomas Bosworth’s social media posts failed to convince a Philadelphia judge to limit the disclosure of certain discovery materials.

Judge Abbe Fletman of the Philadelphia Court of Common Pleas ruled that—at least in the context of a particular discovery dispute—Kline & Specter could not support its assertion.
