Monsanto lost another key court ruling Monday in its fight to toss out Roundup claims based on federal preemption.
The U.S. Court of Appeals for the Eleventh Circuit found that the U.S. Environmental Protection Agency’s registration of Roundup did not carry the “force of law” that preempted Georgia plaintiff John Carson’s claims against Monsanto, now owned by Bayer, for failing to warn about the health risks of the pesticide, which lawsuits have linked to non-Hodgkin lymphoma.
