After Sanctions Row, DLA Piper Leads One Suit Against Bayer’s Mirena IUD to Dismissal, as Identical Suit Is Filed

Bayer’s counsel was seeking sanctions against Bursor & Fisher less than two weeks ago for allegedly filing a consumer class action against its Mirena IUD device without thoroughly investigating the plaintiff’s allegations.

After the parties agreed to dismiss that first suit May 10, attorneys with Bursor & Fisher filed a nearly identical lawsuit this week accusing the pharmaceutical company of failing to warn Mirena users that the contraceptive device significantly increased the risk of breast cancer by approximately 20 to 30%, according to the complaints filed in U.S. District Court for the Northern District of California.
