The Florida Supreme Court entered new rules that experts said are intended to speed up the resolution of civil actions, but one former jurist said it remains to be seen how many lawyers are willing to “publicly call out” the presiding judge in their cases.
“When you file the notice, a copy has to go to the judge,” said Alan Fine, the managing partner at Private Resolutions and an ex-judge on the Miami-Dade Circuit Court bench. “Lawyers are hesitant to do something that has the chance of upsetting the judge. But it is intended to make judges more responsive and to rule more timely, and it will have that effect if lawyers use it.”
