A plasma cutting device used to extract stuck pipes used in oil and gas drilling is not  a “new explosive” and its transport cannot be barred, a federal appeals court ruled.

In issuing its decision on behalf of Arlington, Texas-based MCR Oil Tools LLC, the U.S. Court of Appeals for the Fifth Circuit instructed an agency of the U.S. Department of Transportation on what is and is not an administrative final action.
