Disparities across race in jury selection in Manhattan’s federal court are “troubling” and have only increased in recent decades, a U.S. appeals court said on Thursday.

The comment, in dicta from the U.S. Court of Appeals for the Second Circuit, came in response to arguments from a defendant in a gun case that his indictment should be thrown out due to systemic underrepresentation in the jury pool.
