The Pennsylvania Superior Court reinstated a medical marijuana cardholder’s suit against his former employer, concluding the lower court wrongly threw the case out after deciding a disputed factual issue against the employee.

In a 2-1 majority opinion, the appellate panel reversed the Schuylkill County Court of Common Pleas’ order dismissing plaintiff Michael Kopinetz’s complaint alleging his employer Waste Management and Processors (WMP) terminated him in violation of the Medical Marijuana Act (MMA), after finding out he was a medical marijuana cardholder.
