Ashley Keller, the founding partner of plaintiffs firm Keller Postman, says that when the words “forum” and “shopping” are put together, they’re considered dirty words in some corners.  

But Keller, who argued Mallory v. Norfolk Southern Railroad at the U.S. Supreme Court, a case that yielded a major decision on personal jurisdiction last year, also says a lot of practitioners, if they’re being honest, would say that both plaintiffs lawyers and defense lawyers are “always forum shopping.”
