A divided U.S. Court of Appeals for the Ninth Circuit on Friday dismissed a lawsuit alleging that Facebook’s owner violated the free speech rights of a Robert F. Kennedy Jr.-founded anti-vaccine group by making its posts less visible on the social media platform.
Judges Eric Miller and Edward Korman said Meta Platforms Inc. followed its own private policy on misinformation when it censored the group’s posts, and that the nonprofit Children’s Health Defense failed to allege the government coerced the platform to do so.
