The Dallas County sheriff is challenging the constitutionality of a newly created statewide appellate court—to head off further delay of a lawsuit against Texas Health and Human Services Commission.

The state commission, in an appeal to the Austin Court of Appeals gave notice that it expects the case to transfer Sept. 1 to the newly created Fifteenth District Court of Appeals.
