“With physical presence confirmed, Mr. Davis’ intent regarding his residence in Georgia is what matters, not the number of days or nights he spent at a particular location,” read a motion response prepared by respondent counsel Bryan Tyson of The Election Law Group.

What You Need to Know

  • Petitioner motion filed to include cellphone location data as evidence in residency challenge against Georgia Court of Appeals candidate Jeff Davis.
  • Additional evidence aims to challenge Davis’ qualifying affidavit assertion of residing in Fulton County for one consecutive year.
  • Unable to ‘materially impact the case,’ respondent counsel argue evidence received after April 30 disqualification hearing should not be considered.
  • Office of State Administrative Hearings Judge Stephanie M. Howells to decide whether to accept evidence before rendering a disqualification decision.

Two days after Georgia Court of Appeals candidate Jeff Davis testified at a daylong disqualification hearing, petitioner counsel filed a motion late Thursday night to include additional evidence.

The filing included an analysis of cellphone location data collected from Davis’ mobile device that suggested the former State Bar of Georgia executive director spent less time residing in Fulton County than he’d attested to in his certified candidate qualifying affidavit.
