5th Circuit Case Threatens Structure of Federal Agencies, Legal Experts Say

The U.S. Court of Appeals for the Fifth Circuit heard oral arguments Monday in a challenge to the Consumer Product Safety Commission’s structure in a case that could upend the way other independent federal agencies are set up.

The lawsuit, brought by the groups Consumers’ Research and By Two LP, alleges that a “for cause” restriction on the president’s removal authority for CPSC commissioners under federal statute violates the constitution’s separation of powers.
