A rear-end collision with a tractor-trailer ended in a more than $500,000 settlement.
The case, Stanley v. Ball, was filed in Middlesex County Superior Court. The plaintiff was represented by David Rehe of Brandon J. Broderick Personal Injury Attorney at Law in River Edge, New Jersey. Thomas Gallagher of Thomas Paschos & Associates represented the defendants.
On Jan. 21, 2022, plaintiff Julius Stanley was driving north on the New Jersey Turnpike in Edison, when the passenger’s side of his tractor-trailer cab was struck by the left rear of a tractor-trailer driven by Chrashauna Ball. The impact forced Stanley’s tractor-trailer off the road where it overturned. Stanley suffered multiple fractures of his hand, wrist and leg. Stanley sued Ball and BHF Logistics Inc., which owned Ball’s tractor-trailer. The lawsuit alleged that Ball was negligent in the operation of a vehicle causing severe injury to the plaintiff.
Following the accident, Stanley sought medical attention and was diagnosed with a comminuted fracture of the left distal tibia and closed fracture of the left wrist of his nondominant arm. Stanley ultimately underwent open reductions and internal fixations of his hand, wrist and leg fractures. In the ensuing weeks, he remained nonweight-bearing and eventually treated with a course of physical therapy. The plaintiff continued to consult with his surgeon this year. Stanley sought recovery of damages for his past and future pain and suffering.
The parties negotiated a mediated settlement in February, resulting in BHF Logistics’ carrier, National Independent Truckers Insurance Co., agreeing to pay $525,000.
