A split U.S. Court of Appeals for the Fourth Circuit panel last week allowed a federal inmate’s excessive force claim against several prison officials to proceed, extending the right to sue federal officers for damages over constitutional violations under a landmark U.S. Supreme Court decision.

Andrew Fields claims that officers’ use of excessive at the U.S. penitentiary in Lee County, Virginia, violated his Eighth Amendment right against cruel and unusual punishment.
