A typo in a “Bad Boy Guaranty” is not a defense against liability, a New York state appeals court noted in reversing a lower court decision and awarding summary judgment to the plaintiff in long-running litigation over a defaulted $135 million construction loan.

The decision also awarded financial services company Nomura more than $80 million in recovery following some nine years of litigation, plaintiff’s firm Greenberg Traurig noted.
