The head of Philadelphia’s Complex Litigation Center has declined to step away from the Zantac mass tort over his wife’s alleged ties to one of the defendants.

Judge Joshua Roberts of the Philadelphia Court of Common Pleas denied plaintiffs’ motion for his recusal in an Aug. 15 order, ruling that he could remain impartial in the litigation. However, he suggested his ruling should go to an appeals court sooner rather than later to address what could be an important but tricky legal issue.
