In a dispute that stood to knock hundreds of cases from the Philadelphia Paraquat mass tort program, the Pennsylvania Superior Court has shut down a bid to obtain clarity on lingering questions about the state’s consent by registration statute.

The court on Thursday declined to take up an appeal that appeared poised to become the first case examining the statute to go before a Pennsylvania appellate court since the U.S. Supreme Court’s June 2023 Mallory v. Norfolk Southern Railway ruling.
