West Virginia’s highest court dismissed correctional officers’ petition for qualified immunity, agreeing with a plaintiff-prisoner that his claims of excessive force against the officers should be heard by a jury.
In a March 31 opinion, the West Virginia Supreme Court of Appeals affirmed in part, and reversed in part a circuit court’s decision refusing to afford correctional officers qualified immunity, in addition to denying their motion for summary judgment.
