Washington Appeals Court Reinstates Wrongful Death Suit Amid Questions Over City’s Maintenance of Railroad Crossing

Questions over whether Tacoma properly maintained a roadway with visibility issues remain unresolved, the Washington State Court of Appeals said in reinstating a wrongful death claim brought by a Washington man’s estate against the city.

On April 18, a three-judge appellate panel reversed the Pierce County Superior Court’s summary judgment award to the city, saying an inquiry into whether the city breached its duty to maintain a safe railroad crossing and whether the negligence resulted in Wesley Evans’ death is necessary.
