State Appeals Court Allows Negligence Suit to Proceed, Finding Fire Inspector’s Qualified Immunity in Question

A fire inspector directing pedestrian traffic may not be protected by qualified immunity in a personal injury lawsuit, the Georgia Court of Appeals has ruled.

In a denial of a motion to dismiss negligence claims, the court allowed a lawsuit brought by a man hit by a moving vehicle to move forward against a Cobb County fire inspector.
