‘Quite a Stretch’: 9th Circuit Panel Skeptical of Judicial Misconduct Allegations in RICO Case Against Wynn Resorts

An appeals court panel appeared reluctant to revive a civil RICO lawsuit against Wynn Resorts, calling the allegations “a stretch” that the casino and hotel company influenced the judicial process with surreptitious payments to secure dismissal of the litigation.

During oral arguments Tuesday, a panel for the U.S. Court of Appeals for the Ninth Circuit questioned the legal theory presented by counsel for a former Wynn Las Vegas salon manager, Angelica Limcaco, who filed an underlying 2018 employment lawsuit. Limcaco claims she was wrongfully terminated and intimidated after reporting allegations that former casino mogul Steve Wynn—who was accused of misconduct in the early days of the #MeToo Movement—raped and impregnated a manicurist in the salon.
