The Oregon Supreme Court has ruled that a lower court erred in rejecting an unopposed motion to dismiss without first holding a hearing.
In an April 6 opinion written by Justice Christopher L. Garrett, the unanimous court concluded that the appellate court erred in denying criminal defendant Charles Anthony Mott Jr.’s unopposed motion to dismiss.
