Municipal Immunity Question Could Rise to Ga. Supreme Court

A Georgia Court of Appeals panel composed of Presiding Judge Stephen Dillard and Judges Brian Rickman and Trea Pipkin recently heard a case exploring the reach of sovereign immunity by testing the waters of a recent amendment to the state Constitution that created a waiver for municipal immunity in injunction claims.

Because the court was confronting a novel issue affected by a recent constitutional amendment and the court’s disposition in Sons of Confederate Veterans v. Henry County Board of Commissioners, Dillard said the legal action may bypass the panel entirely and go up to the state Supreme Court.
