‘Misconstrued’ Firearms Statute Leads Virginia Court To Reverse Order

While the Virginia Court of Appeals said a lower court in part reached the correct conclusion in not granting relief, it reversed a ruling to be dismissed because there was an apparent “misconstrued” interpretation of the last antecedent in the clause pertaining to a nonresident’s petition to restore gun rights.

According to an April 25 opinion written by Judge Stuart A. Raphael, the appellate court said that the trial court had correctly concluded it couldn’t grant relief to Susan Marie Focke, who petitioned the court to restore her firearm rights that were lost due to a federal felony conviction in the U.S. District Court for the Eastern District of Virginia, Norfolk Division after she was convicted of felony bankruptcy fraud in 2017.
