‘March Madness’ in Courtroom For Kansas State University, as Judge Allows COVID-19 Class Action to Proceed

A Kansas appeals court has allowed former Kansas State University students’ class action suit against the university to survive, finding the plaintiffs sufficiently pleaded breach of contract claims over the school’s move to remote learning during the pandemic.

In a March 24 opinion, the Kansas Court of Appeals affirmed in part, reversed in part, and remanded for further instruction, a district court’s ruling dismissing ex-students’ lawsuits brought against Kansas State University, arising out of campus closures and online classes due to COVID-19 in the spring of 2020.
