A Manhattan judge has said those 40 and older terminated by NYC Health and Hospitals as part of a cost-cutting initiative constitute a class and can continue their lawsuit for discriminatory termination.

Jeffrey Wallach, a former manager at HHC, was terminated in June 2017. His 2018 lawsuit alleged that a second round of layoffs under an HHC program known as Management Efficiency Improvements Initiatives, or MEII, disproportionately affected older employees. Wallach sued pursuant to New York City Human Rights Law, New York City Administrative Code § 8-101.
