A hospital has a shot at seeking payment for a $17 million verdict award from the employer of two doctors found to be negligent in a medical malpractice action, thanks to a ruling from the Pennsylvania high court.
In a July 28 opinion, the justices unanimously held that the Washington Hospital may pursue contribution from Dialysis Clinic Inc., so long as the two parties are ultimately determined to be vicariously liable for the doctors’ negligence. The justices were split, however, as to whether the hospital should be permitted to obtain indemnity against DCI.
