Health Care Firm Hit With Privacy Suit Over ‘Imminent Risk’ of Data Breach

OptumCare was hit with a consumer class action on Aug. 8 in California Superior Court for Los Angeles County. The suit, filed by the Wilshire Law Firm, accuses the defendant of failing to implement adequate safety measures to protect patients’ personally identifiable information and HIPAA-protected health information. Notably, the suit does not arise from a hack or data breach, but instead asserts that class members have ‘lost the benefit of their bargains with Optum’ due to an ‘imminent and impending risk’ of a breach. Counsel have not yet appeared for the defendant. The case is 23STCV18833, Aguilar et al. v. OptumCare Management LLC et al.
