Ga. Court of Appeals Mulls Local Business Establishment’s Duty to Prevent Crime

Former Georgia Attorney General Michael Bowers and co-counsel Lucas Boggs approached the Court of Appeals on behalf of their client and plaintiff-appellant, a convenience store located in the Atlanta’s Edgewood neighborhood. Their purpose on Tuesday was to ask the court whether the city government is able to require the business to change its hours of operation, install new lighting and hire private security.

The city of Atlanta, which Pat Dixon Jr. argued on behalf of, contended that the convenience store and service station, Edgewood 400, was a public nuisance. Edgewood Avenue, where the business is located, is also home to several nightclubs, which close in the early hours of the morning. The city said that, after the clubs close, their patrons gravitate toward the 24/7 convenience store, which is poorly lit and sells alcohol, where they hang out in the parking lot.
